
Broker Policy
At Malpak, we uphold a stringent due diligence process and expect the same level of diligence from all brokers and facilitators seeking collaboration. Brokers not directly linked to either end buyers or end sellers should refrain from attempting contact to Malpak.
Please review the following carefully, as it will determine whether Malpak will engage with you:
Non-Circumvention Agreements
We receive requests to sign an NCNDA (Non-Circumvention Non-Disclosure Agreement) and an IMFPA (Intermediary Master Fee Protection Agreement). Our team is open to signing an NCNDA, provided it is authentic and associated with a live deal. We do not sign agreements in advance of verified deals as genuine mandates are safeguarded by the issuing company and are not concerned about circumvention.
We exclusively utilise the genuine ICC Publication 769 E (ICC Model Contract). Any other NCNDA draft, typically featuring the ICC logo and titled ICC 400/500/600, will not be considered.
Malpak will not sign an NCNDA with every individual or company claiming a direct connection to their principal. Brokers seeking collaboration must furnish detailed company information, including a website, corporate profile, registered office address, and working phone numbers. Emails from public domain servers will not be accepted.
Broker Chains
Malpak does not accommodate lengthy broker chains. Brokers approaching Malpak must have a direct connection to their principal (end-buyer or end-seller). No exceptions apply to this rule. In the interest of clarity, Malpak will not enter into any agreements involving a group of parties in connection to a principal.
While we welcome new brokers, we expect them to be well-prepared before contacting us. Direct connections ensure transparency and efficiency.
Due Diligence
We expect brokers to conduct thorough due diligence before forwarding any documents or inquiries. As brokers, it is our responsibility to ensure comprehensive preparation before presenting to our principals. Similarly, it is your responsibility to ensure the authenticity and validity of any documents you provide. Law enforcement and blacklist organisations will be notified if we uncover any fraudulent activity.

You possess knowledge of the commodity.
You're directly linked to the end buyer/seller.
You're willing to exchange your principal’s details.
You've conducted thorough due diligence.
